Average Truck Accident Settlement in New York: Amounts & Examples

Call Now to Request a Free Consultation (646) 647-3398

Most New York truck accident cases settle somewhere between about $100,000 and $2 million, with serious-injury cases often landing in the high six figures to low seven figures and catastrophic cases reaching $2 million to $14 million or more. These bands come from publicly reported New York verdicts and settlements, plus New York City's own paid-claims data. They are ranges, not promises. What your case is worth depends on your injuries, who was at fault, and how much insurance is available.

Important: The figures below are illustrative ranges drawn from public data and cited New York cases. Prior results do not guarantee or predict a similar outcome. Every case is unique. This page is attorney advertising and is not legal advice.

Truck cases tend to pay more than ordinary car accident cases for one main reason: the insurance behind a commercial truck is much larger. Federal law requires most interstate trucks hauling general freight to carry at least $750,000 in liability coverage, and many carry $1 million or more. A private car driver in New York may carry as little as $25,000. That gap is why a tractor-trailer crash and a fender-bender with similar injuries can settle for very different amounts.

Truck Accident Settlement Ranges by Injury Severity

Injury severity is the single biggest factor in any New York truck accident settlement. The bands below show how cases tend to group. They are starting points for discussion, not guarantees.

Injury severity Typical range What usually drives the number
Minor $30,000 – $150,000 Soft-tissue injuries, short treatment, full recovery, modest lost wages
Moderate $150,000 – $500,000 One surgery, months of treatment, some lasting limits, real lost income
Severe $500,000 – $2 million Major surgery, permanent disability, long recovery, large medical bills
Catastrophic / fatal $2 million – $14 million+ Brain injury, spinal cord injury, amputation, or wrongful death

The City of New York's own claims data shows the same pattern. Across motor-vehicle claims paid by the City from FY2016 to FY2023, the median payout was modest, but the top 10% of payouts crossed $75,000 and the largest single auto payout reached $10.5 million. Serious truck cases sit at the high end of that spread, not the middle.

Truck Accident Settlements by Crash Type

How the crash happened affects both liability and value. Some collision types tend to produce more severe injuries, which pushes settlements higher.

Crash type Why it matters for value
Rear-end by a truck Clear liability is common; injury severity drives the range
Jackknife or sideswipe Often multiple lanes and vehicles; carrier and driver both liable
Override / underride A smaller vehicle goes under or is run over; injuries are often catastrophic
Pedestrian or cyclist struck Severe injuries; the truck's large policy often applies in full
Falling cargo or debris Loader and carrier may share fault; head and neck injuries common

What Drives the Value of a New York Truck Accident Case

A real number needs the real facts. Here is what moves a New York truck case up or down.

Federal trucking insurance (the biggest reason trucks pay more)

Under federal rules (49 CFR Part 387), an interstate carrier hauling general freight must carry at least $750,000 in liability coverage. Carriers hauling hazardous materials must carry far more, up to $5 million. Many trucking companies and freight brokers require $1 million as standard. That large policy is often what makes a meaningful recovery possible, because the coverage limit caps what an insurer will pay no matter how strong the case is.

Multiple parties who can be held responsible

A truck crash rarely involves just one defendant. Depending on the facts, you may have a claim against the driver, the trucking company that employed them, the company that owned the truck or trailer, the business that loaded the cargo, and any maintenance contractor. More responsible parties usually means more available insurance to cover your losses.

New York's no-fault rules and the serious-injury threshold

New York is a no-fault state. Your own coverage (PIP) pays your initial medical bills and part of your lost wages up to $50,000, no matter who caused the crash. To recover for pain and suffering from the at-fault truck side, your injury must meet the "serious injury" threshold in Insurance Law § 5102(d). That includes a fracture, significant disfigurement, a permanent or significant limitation, or an injury that keeps you from your usual activities for at least 90 of the 180 days after the crash. Clearing this threshold is what opens the door to a full settlement.

Evidence that only exists in truck cases

Commercial trucks carry electronic logging devices, engine "black box" data, and driver hours-of-service records. Carriers also keep maintenance and inspection files. This evidence can prove a tired driver, a skipped repair, or an overloaded trailer, but it can disappear fast. A prompt letter demanding that the carrier preserve it often makes the difference.

Your injuries, bills, and lost income

Surgeries, permanent injuries, and conditions like traumatic brain injury or spinal cord damage carry the highest values. Your past and future medical bills, your lost wages, and any loss of future earning capacity all factor into the number.

Comparative fault

New York uses pure comparative fault (CPLR § 1411). If you were partly at fault, your recovery is reduced by your share, but you are not barred from recovering. A driver found 20% at fault can still collect 80% of the damages.

Where the case is filed

Juries in different New York counties tend to value cases differently. Venue can affect both the settlement range and the trial value of a case.

Real New York Truck Accident Examples

The numbers below are real, sourced results. They show the spread, not what any individual case is worth.

The Orlow Firm's truck-involved results (from our published Success Stories; prior results do not guarantee a similar outcome):

  • $997,997 for a taxi driver hit head-on by a truck, requiring back surgery.
  • $750,000 for a passenger in a work-vehicle crash with a truck, requiring neck and back surgery.
  • $750,000 for a worker who fell from a lift struck by a garbage truck, requiring hip surgery.
  • $675,000 for a client rear-ended by a tractor-trailer, with both shoulders requiring surgery.
  • $650,000 for a bus passenger struck by a tractor-trailer, requiring hand and shoulder surgery.

Publicly reported New York truck cases (reported by a New York verdict reporter, Block O'Toole & Murphy):

  • $14,000,000 settlement — a tow-truck operator on a motorcycle was struck by a truck in Nassau County and suffered a below-the-knee amputation.
  • $5,500,000 settlement — a pickup driver was sideswiped by a dump tractor-trailer in Brooklyn.
  • $2,500,000 settlement — a mail clerk was struck by a tractor-trailer during a snowstorm on I-90 near Rotterdam, New York.
  • $1,900,000 settlement — a head-on crash caused by a truck's improperly maintained brakes left the victim with a closed-head brain injury.

New York City paid-claims data: Across motor-vehicle claims the City paid from FY2016 through FY2023, the top 10% of payouts exceeded $75,000 and the largest single payout reached $10.5 million. These are claims paid by the City only; private trucking settlements are confidential and not included, so the real picture for commercial truck cases skews higher.

How to Estimate Your Own Case

There is no calculator that can value a truck accident case from a web page, because the number depends on facts only you and your records can supply: the exact injuries, the available insurance, the degree of fault, and the strength of the evidence. The honest way to get a real estimate is to have a lawyer review your specific situation.

Frequently Asked Questions

Is a New York truck accident settlement taxable? Most personal physical-injury settlements are not taxed under federal law. Money for medical bills, pain, and suffering tied to a physical injury is generally tax-free. Portions for lost wages or punitive damages can be taxable. Ask a tax professional about your specific settlement before you file.

How long does a truck accident settlement take in New York? It varies widely. A clear-liability case with finished medical treatment can settle in months. A serious case with disputed fault or a lawsuit can take a year or more. Cases usually settle for more once your medical treatment is complete and the full extent of your injuries is known.

Will I have to go to court for a truck accident case? Most New York truck accident cases settle without a trial. Filing a lawsuit is often part of the process, but that does not mean you will testify in front of a jury. Many cases resolve during the lawsuit through negotiation or mediation.

What if I was partly at fault for the truck crash? You can still recover. New York uses pure comparative fault (CPLR § 1411), so your recovery is reduced by your percentage of fault rather than blocked. If you were 25% at fault, you can still collect 75% of your damages.

Why are truck accident settlements higher than car accident settlements? Commercial trucks carry far larger insurance policies. Federal law requires at least $750,000 in coverage for most freight trucks, and many carry $1 million or more, compared with as little as $25,000 for a private New York driver. There are also usually more responsible parties to pursue.
