Pedestrian struck by car agrees to $300,000 settlement


Being the victim of an accident, especially one involving such an innocuous act as crossing the street, is often cause to seek legal counsel. In many such incidents, the victim is entitled to damages for injuries and expenses sustained as a result of someone else's negligence.

A 55-year-old New York City Department of Education social worker from Staten Island recently agreed to a settlement of $300,000 in a pedestrian accident case. The woman was crossing Amboy Road and Clarke Avenue when she was struck by a car nearly two years ago. The settlement was agreed to prior to an approaching court date to determine damages.

The social worker suffered injuries to her left knee and was transported from the accident scene to a nearby hospital. Her injuries required surgery, resulting in her being off work first for seven months, and then again later for five months. She has since returned to work. During that time, however, it is likely that she was not receiving the paycheck that she had become used to seeing. Thus, it is likely that the settlement agreement is partially covering lost wages during the time off.

In recent months, a state Supreme Court justice granted the woman's motion of summary judgment on liability against the driver of the car that struck her.

Fortunately, the woman was able to provide enough evidence to allow the judge to determine the woman's accident was not her fault. Utilizing the skills of a lawyer may result in an easier process of convincing a judge that the crash was not because of any failure on the part of the victim. Without such assistance, it maybe nigh impossible to move a legal claim forward.
